New York follows the 40-hour workweek rule, but its exempt salary thresholds are among the highest in the country — so plenty of 'salaried' New Yorkers are legally owed overtime. Enter your week to see what you are due.

Quick answer: New York overtime is 1.5× the regular rate for hours over 40 in a workweek, under both the FLSA and the New York State Labor Law. New York has no general daily overtime rule, but its exempt salary thresholds ($1,275/week in NYC, Long Island and Westchester) are far higher than the federal floor.
New York overtime rules
New York State Labor Law §7 and the FLSA both require:
- 1.5× the regular rate for hours worked over 40 in a workweek.
- No general daily overtime — a 12-hour day is straight time. Narrow exceptions exist for specific occupations (some 24-hour home-care shifts, railroad and certain utility workers).
- Spread of hours — if your workday (start to finish) exceeds 10 hours, some workers are owed one extra hour at minimum wage. This is separate from overtime.
- Call-in pay — reporting to work when no work is available can trigger a minimum payment (typically 4 hours in hospitality).
New York also requires overtime to be paid at the regular rate, which includes non-discretionary bonuses, shift differentials and commissions — not just the base wage.
New York minimum wage in 2026
New York's 2026 minimum wage is $17.00/hour for New York City, Long Island and Westchester County, and $16.00/hour for the rest of the state. Annual CPI indexation begins in 2027. Tipped food-service workers have a separate cash wage that brings total pay to the full minimum.

Who is entitled to overtime in New York?
To be exempt in New York in 2026 an employee needs the duties test and a salary of at least:
- New York City, Long Island and Westchester: $1,275.00 per week ($66,300 a year).
- Rest of New York State: $1,199.10 per week ($62,353 a year).
Both figures are well above the federal $684 a week — so an assistant manager on $50,000 in Buffalo is non-exempt and owed overtime for hours over 40, even if the employer calls the role salaried.
