Texas Overtime Calculator
Texas has no state overtime statute. That sounds like bad news, but it makes the maths simple: the federal FLSA gives you 1.5× for every hour over 40 in a workweek — and there is no daily overtime, no double time and no 7th-day premium unless your contract says otherwise.

Quick answer: Texas overtime is federal overtime: 1.5× your regular rate for hours worked over 40 in a workweek. A 12-hour shift is not overtime in Texas on its own — only the weekly total beyond 40 triggers it.
How Texas overtime works
Texas has never passed its own overtime law, so the Fair Labor Standards Act sets the floor:
- 1.5× the regular rate for hours over 40 in a workweek.
- No daily overtime. Three 12-hour shifts (36 hours) are all paid straight time.
- No double time requirement at state or federal level.
- No 7th-day premium — a 7-day week is only expensive if it passes 40 hours.
What is Texan: the Texas Payday Law, which lets you file a wage claim with the Texas Workforce Commission for unpaid overtime, unpaid commissions and final pay. It covers most private employers and is free to use — a genuinely useful remedy most workers do not know about.
Some employers apply an 8 and 80 rule (overtime after 8 hours in a day or 80 in a 14-day period) in healthcare and hospital settings. That is a contractual policy, not Texas law — it can be more generous than the FLSA but it is not required.
Texas minimum wage in 2026
Texas uses the federal minimum wage of $7.25/hour and has not raised it since 2009, making it one of 20 states still at the federal floor. There are no state or city minimum wage ordinances in Texas — a 2023 state law prevents local governments from setting their own. The tipped cash wage remains $2.13/hour with a $7.25 full minimum after tips.

Who is entitled to overtime in Texas?
Most hourly workers in Texas are non-exempt and owed overtime. Salaried employees are exempt only if they are paid at least $684 per week (the federal threshold, $35,568 a year) and pass the duties test as executive, administrative, learned professional, computer or outside sales.
The 2024 attempt to lift that salary threshold to $844 then $1,128 a week was vacated by a federal court, so the $684 figure is what applies. Watch this space — it is the most litigated number in American payroll.
