Ohio overtime follows the federal 40-hour rule with no state daily threshold. The quirk is on the minimum wage side: whether the state rate applies depends on your employer's annual gross receipts.

Ohio overtime rules

Ohio relies on the federal FLSA plus a state constitutional minimum wage amendment:

Ohio's minimum wage is set by a constitutional amendment passed in 2006 and rises with inflation each 1 January, which is why the small-employer receipts threshold creeps up every year too.

Ohio minimum wage in 2026

Ohio's 2026 minimum wage is $11.00/hour for employers with gross receipts of $405,000 or more, and $7.25/hour for employers below that threshold. Both figures are adjusted for inflation annually. Who is entitled to overtime in Ohio?

Ohio uses the federal $684 a week salary threshold plus the duties test. Ohio has no additional state exemption salary, but it does recognise the fluctuating workweek method, which many other states restrict — meaning overtime for salaried non-exempt Ohio employees can legally be paid at half-time rather than time-and-a-half.

Separate employers do not combine hours for overtime purposes: 45 hours across two unrelated jobs is not 5 hours of overtime. Hours from a staffing agency and its client can be combined, however, if they are joint employers.
